Privacy Policy

Flex 'n Burn LLC ("Flex 'n Burn," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the rights you have — including specific rights granted to California residents under the California Consumer Privacy Act, as amended by the California Privacy Rights Act ("CCPA/CPRA").
This policy applies to information collected through flexnburn.com, our mobile experiences, our studio in Valencia, CA, and any related Flex 'n Burn services (the "Services").
1. Information We Collect
We collect the following categories of personal information as defined under the CCPA/CPRA:
- Identifiers: name, email address, phone number, mailing address, account username, IP address
- Customer records: billing address, payment card information processed by our payment provider
- Commercial information: memberships and class packages purchased, attendance history, transaction records
- Internet and network activity: pages visited, links clicked, browser and device type, referring URL, cookie data
- Approximate geolocation derived from IP address
- Sensory information: security camera footage in and around the studio
- Health-related information: injuries, conditions, pregnancy, or limitations you voluntarily disclose for safety, and emergency contact info
- Professional or educational information: only if you apply for employment
- Inferences drawn from the above (member preferences and engagement patterns)
Health-related information you share for safety purposes and your account login credentials are considered "sensitive personal information" under the CCPA/CPRA. We use sensitive personal information only for the purposes for which it was provided (such as keeping you safe in class and securing your account) and do not use it to infer characteristics about you. You have the right to limit certain uses of sensitive personal information (see Section 6).
We collect this information directly from you (when you sign up, book, contact us, or visit the studio); automatically (cookies, analytics, security cameras); and from service providers (such as Mariana Tek (operated by Xplor), payment processors, and email and SMS platforms).
2. How We Use Your Information
We use personal information to:
- Create and manage your account and membership
- Process payments, bookings, and refunds
- Send transactional messages such as booking confirmations, billing notices, and account alerts
- Send marketing and promotional messages with your consent where required
- Operate, secure, maintain, and improve the website and studio
- Respond to inquiries and provide customer support
- Keep members and staff safe (including video surveillance and disclosure of relevant health information to coaches)
- Comply with legal obligations and enforce our Terms of Service
3. How We Share Your Information
We do not sell your personal information for money, and we do not share it for cross-context behavioral advertising as those terms are defined under the CCPA/CPRA.
We disclose personal information to service providers and contractors who process information on our behalf under written contract — including Mariana Tek (operated by Xplor) for booking, payments, and member management; Stripe and other payment processors; email and SMS providers; and website hosting and analytics providers (such as Google Analytics).
We also disclose information to professional advisors such as accountants, lawyers, and insurers when reasonably necessary; for legal and safety reasons (to comply with subpoenas, court orders, or applicable law; to enforce our Terms; or to protect the rights, property, or safety of Flex 'n Burn, our members, staff, or the public); and in connection with a merger, acquisition, financing, or sale of all or part of our business.
4. Cookies, Analytics & Tracking
We and our service providers use cookies, pixels, and similar technologies to remember your preferences, keep you signed in, measure site traffic, and understand how the Services are used. You can control cookies through your browser settings; disabling them may limit some functionality.
Analytics. We use Google Analytics to collect aggregated data about website usage (pages visited, session duration, device type, referring URL). Google Analytics may set its own cookies and collect information about your activity on this and other websites over time. You can opt out of Google Analytics data collection by installing the Google Analytics Opt-out Browser Add-on.
Booking & account platform. Our booking, scheduling, and membership management is powered by Mariana Tek (operated by Xplor Technologies). When you interact with those features, Mariana Tek may also set cookies and collect usage data in accordance with their own privacy policy.
Third-party tracking. Third parties such as Google (via Google Analytics) may collect personal information about your online activities over time and across different websites when you use our Services. We do not control those third parties' tracking technologies or policies.
Do Not Track. Our website does not respond to Do Not Track (DNT) browser signals. If you wish to limit tracking, you may use your browser's privacy settings or the opt-out links above.
5. Retention
We retain personal information only as long as needed for the purposes described in this policy, to comply with our legal obligations (including tax, accounting, and contract-enforcement requirements), to resolve disputes, and to enforce our agreements. Inactive account data is generally retained for up to 7 years and then deleted or de-identified.
6. Your California Privacy Rights
If you are a California resident, you have the right to:
- Know the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it (covering the prior 12 months, or longer at your request)
- Request deletion of personal information we collected from you, subject to legal exceptions
- Request correction of inaccurate personal information
- Opt out of any sale or sharing of your personal information (we do not sell or share, but this right is preserved if our practices ever change)
- Limit our use of sensitive personal information to purposes specified by law
- Non-discrimination for exercising your privacy rights
- Request a Shine the Light disclosure under Cal. Civ. Code § 1798.83 (we do not currently disclose personal information to third parties for their own direct marketing purposes)
To submit a verifiable consumer request, email info@flexnburn.com with the subject line "California Privacy Request," or call (661) 990-8335. We will verify your identity using information already on file (such as your account email and phone number) before fulfilling a request to know, delete, or correct. We will respond within 45 days, with one 45-day extension if reasonably necessary. You may also designate an authorized agent to submit a request on your behalf with written, signed permission.
7. SMS / Text Message Communications
If you opt-in to text messages, we send you transactional and marketing texts at the number you provide using automated systems. Your consent is not a condition of any purchase. Message and data rates may apply. Message frequency varies. Reply STOP to opt out at any time or HELP for assistance. We do not share mobile opt-in data or phone numbers with third parties or affiliates for their own marketing purposes.
8. Children
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. For California residents under 16, we do not sell or share personal information without affirmative opt-in (and from a parent or guardian for those under 13). If you believe a child has provided us with personal information, contact us at info@flexnburn.com and we will promptly delete it.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information. No system is perfectly secure, however, and we cannot guarantee the security of information transmitted over the internet. You are responsible for keeping your account credentials confidential.
10. Third-Party Links
Our website may link to third-party websites. We are not responsible for those sites' privacy practices. Please review their policies before sharing information with them.
11. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be posted with a revised effective date. We encourage you to review it periodically.
